The family of 8 year old Amber Sadiq, who was killed by a runaway school bus in May, will file a wrongful death lawsuit against the city. An 8 year old boy, T. James, who had been reprimanded repeatedly by the school and sent home had released the brakes of the empty bus, causing it to careen towards Amber and her brother, Umar. According to the Daily News, the lawsuit will ask for millions in damages for the little's girl death on a Brooklyn street, as well as damages for Umar who had to see his sister die on their way home from school. The notice of claim included charges of the city's "negligence for failing to secure the school bus, hiring incompetent workers and failing to supervise the troubled 8-year-old boy." What's interesting is that home suspensions are illegal, which would make PS 161's decision to send James home questionable.
There had been some talk of charging the 8 year old in Sadiq's death, but even the Sadiq family did not want that to happen.

Who actually owns and runs the school bus? The School System of a private company? Even if the city does own the bus in question, and they are somewhat responsible, It looks like the Lawyers are again in a feeding frenzy.
Maybe they should sue the brat who caused the death as well, but he doesn’t have deep pockets! No Dice.
I don't know if litigation will solve anything in this particular case, as it seems to be one troublesome boy and a freak accident, but all I know is that the story makes me sad.
Don't know about a Bus, but the owner of an Automobile is responsible for what it is used for.

The city should not pay one red cent. I think the family filing suit is confused. I don't think this is what is meant by "the land of opportunity." The only tragedy is that they think they can get money from this situation.
The family can go get the compensation from Mayor Bloomberg who said that "locking the young boy up is senseless." Put him in juvenille lock down.
The city is in no way responsible for a childs mental illness when they have a guardian. The school is not responsible for a child once the child leaves the school grounds. I am certain the family was asked to pick their child up. They are always told when their child is kicked off campus for posing danger to other children. And further more, the boys's parents should be on trial for not getting help for their mentally challenged kid. He obviously has serious issues.
How dare they try to say that the bus driver was incompetant. Is every driver in the city incompetant because they turn their cars off at night and retire for the rest of the day inside their homes. Or a driver can not park a car and go buy grociers for fear a PSYCHO will go and do harm with their vehicle? No.
A good lawyer should try the child in court. The bus was weapon and the child intended to create trouble. He had been told on several occasions to straighten up and stop acting out. Either the boy is retarded and/or a truant making trouble. He had intent. Put the boy on trial. The city has nothing to do with the death of the little girl.
what the fuck? a little mischievous black kid kills another kid and you sue the city? I was at Pathmark the other day with the self checkout machines and there were these 2 little black kids trying to steal from everyone on the line. They even tried to cancel my order on the machine when I was bagging my groceries. I yelled at them and their father was like "why are you yelling at my kids?" and then I told him they cancelled my order and then he smacked both of em extremely hard. I was in shock. No wonder these kids turn into criminals when they grow up. Poor Supervision.
The bus driver should not have left the bus unlocked and unsupervised. If he has to run to "go buy groceries" as mh suggested, then he should have known better than to leave the bus unlocked. Bus driver and bus company should be held accountable. Although none of this will bring the little girl back.

I think you are confused. You are the one that was yelling at the children. Do you think that is ok? That would give any child a complex and a distrust of adults. You and the father were out of control. The children will have a problem in life because their father did not force you to back off. It is not your place to discipline another person's children especially with anger.
The father was not loyal to his children. He took your word at face value. He did not stop to ask questions. As a parent, I wouldn't have given you the satisfaction by repremanding my children in your presence. Especially, not with hitting. Both of you adults potentially damaged the children in that moment. I would have explained your ignorance to my child first. The scary thing is that you actually think that you were justified in raising your voice. Gee, why not just slap them yourself.
By the way, it was not two black children in the story of the little girl getting hit by a bus. The two black children were in your story. Remember they got in the way of the transaction. Get your facts straight.

The kid boarded the bus through a door which is illegal to lock. It is an exit door for emergency purposes. The kid knew how to operate the door because he boarded another bus three days prior to the incident.
As you know, you can lock a car. However, a car will still get stollen. The bus driver did everything correctly in securing his bus. MTA bus drivers take lunches and leave their buses parked on the street. I have seen them flip a switch through a window or the outside electric switch to gain access. The bus is never completely closed off accept when parked at the depo.
Normal people in a society can not afford to focus on the one in a million nut case that will take advantage of a situation that is slightly vulnerable.
