Judges Rule Queens Judge Out

Even judges can be judged. And in this case, the verdict is "You're out!" State Supreme Court Justice Laura D. Blackburne was "fired" by the state Court of Appeals, regarding that 2004 incident where she let a robbery suspect evade arrest. The suspect was in Justice Blackburne's court for a different hearing, and a detective was waiting outside to question him; Blackburne knew the detective was waiting outside, but advised that the suspect be taken out a back entrance. Blackburne was suspended from the bench during the investigation, and the Commission on Judicial Conduct had recommended her removal. Blackburned appealed, but yesterday, the court ruled 5-2 that she "transcended the boundaries of acceptable judicial behavior" and the Commission's recommendation stands. Though the robbery charges against Derek Sterling were eventually dropped, the court found problems with Blackburne's action. From Newsday:

Though it was a single instance of misconduct, the high court said Blackburne acted out of "anger and pique" over a mistaken belief that [Detective] Devlin had lied to her about why he had come to court. Though she had chances to rectify her mistake on the spot, Blackburne pressed a court officer to allow Sterling to leave despite concerns by prosecutors it might be an obstruction of justice.

Blackburne "placed herself above the law she was sworn to administer," said the decision.

Nassua County State Supreme Justic Dana Winslow tells Newsday, "I do believe it [the decision] can have a chilling effect on the conduct of judges throughout the state." Blackburne has also had a prickly relationship with the police; in 2002, she dropped charges against an alleged cop-shooter, claiming he was denied a speedy trial. The Policeman's Benevolent Association is happy about the ruling, calling her a "noted cop hater."

This judge is being railroaded. The system is trying to strip her of her dignity (career) and embarrass her. Justice Blackburne worked very hard to attain a judgeship. The political system in New York City is incestuous and infested with evil people.

Most people with any kind of insight knows that the judicial system is screwed up. Many people in the prison system do not belong there. The prisons are slave institutions which treat people like animals and do not try to rehabilitate them. Justice Blackburne was fighting against a system to big for her cause. She should not have tried to go against the system alone.

And for you knuckle heads that try to read race into this thread...don't go there. This thread is about justification.

I'm surprised the PC Ray kelly didn't pile on the judge. just patooki and bloomberg.
well, we know how pat lynch feels about her.
we need more judges like the honorable justice Blackburne.

This is the same judge that worked for the city's housing auhtority back in the day and was convicted for using city funds to pay for personal perks, including a big pink leather couch in her office....

I don't think that using public funds in this way (and there was more than a couch involved) is particularly upright; it might not be germane to the case here, but just so you all know she's no angel.

Brooklyn judges are probably the most corrupt in this country (outside New Orleans). Basically, anybody can be a judge in Brooklyn (as long as you hand out $50,000 to local chief of the democratic party).

This nutcase sounds very typical far-left activist judge who is actively helping cop-killers and other career criminals.

MH, You don't find it Unusual that a Judge helped a wanted criminal avoid questioning by the Police?

Just punishment or Not, she's went out of her way to help a wanted criminal escape. That's hardly the actions of an impartial judge.

I don't condone criminals walking free. However, lets make sure that potential innoscent or guilty people are not being harrassed. Lets make sure that the NYPD is not pulling rank whenever a situation suites them.

I don't have an inside angle into the political system of NYC. However, I would bet that it is a system that is so large and uncontrollable. I beleive she saw something that was going down and it wasn't right and justified. Officials have to follow the law too. However, if it is the NYPD's dirty laundry that a person is showing, they are going to go after you. They don't like it when anyone gets in the their way. I am not talking aboout obstruction of justice but, official doing things the way they want them done. When she desided to do the same as they were doing, they went after her.

Only one fact needs to be considered: the Judge broke the law. She knew that an officer was attempting to arrest a suspect in a felony case. The Judge is sworn to uphold the law, yet she chose to help the suspect flee, evading arrest. You or I could be arrested, charged, prosecuted and imprisoned for this act. They cut her plenty of slack by simply removing the incompetent political hack from the bench. We're all a lot better off without her. Antone who thinks this has anything to do with her being "persecuted" because she's black probably believes Simpson didn't murder his wife and Ron Goldman.

he can't, he has debilitating arthritis,
he could barely hold a golf club.
Justice Blackburne was railroaded.
We all need judges like her,
The Country needs judges like her.

In all respect MH, I don't think so. If you read the Court's decision, you'll see that she was advised that this was possible Obstruction of Justice by the prosecutor and the Court Officer. She even entered into the public record that where she stated:

"I resent the fact that a detective came to this court under the ruse of wanting to ask questions when, in fact, he had it in his head that he wanted to arrest you."
She never spoke to the Detective, merely assumed that he lied (Apparently he didn't) and never bothered to check.

This isn't a Brave Webel, She didn't try to go against the system, she was just Pissed Off based on a bad assumption.

Maybe she was punished too severely, I don't know. I do believe, however, that people need to be accountable for their actions. Seems that happened here.

no they don't but, I know Ethan Allen might custom make one for you. You may get the same type of deal the judge received for her sofa, especially if you mention her scenario. Also, I don'think the judge shops at Jennifer Sofa anyway. That is like shopping at Walmart or Woolworth. Her salary warrant a high end product.

S.D. of course the transcript are going to read the proper decision. Yes she acted with poor judgement. Her move was unprofessional. However, I am talking about a slanted system in NYC that she "assumed" she would be able to play hard ball within.

I was not there either, however, I trust her instincts were probably correct that day. I would bet she has seen the NYPD detectives behaving with the same ill manner in other cases with other judges. All speculation.

You are correct. The bottom line is that she made a hudge public and professional error and paid handsumly for it.
