To be leaglly guilty of murder, the suspect must be able to have foreseen the death of the victim as a reasonably consequence of his action. That would not be possible for this 8 year old taking the action he did.

No, I think the boy sounds like a mischievous child who made a terrible mistake and needs a lot of attention and help. It's really sad.
