Cop On Cop Shooting Update

2006_01_copshotvideo.jpgMore news about the wild shooting of the off-duty police officer Eric Hernandez by another cop at a Bronx White Castle during massive confusion (there was a gang present): First of all, it looks like Hernandez was drunk, as his blood alcohol was twice the legal limit when he was admitted to the hospital for the multiple gunshots. And police officers are not supposed to draw their guns when they are drunk; at the time Hernandez drew his gun, he had been beaten. Second, surveillance tapes show him getting brutally beating by the gang - which may have affected his ability to hear the other officer's warning shouts to drop his gun. Police only realized Hernandez was a cop when they found his badge in his pocket - after police officer Alfredo Toro, who responded to the scene earlier, had shot Hernandez. The tapes also show how an argument between a group of people and the White Castle manangement turned into a fight between the gang and Hernandez; plus how Hernandez crawled outside and how the group stole his burgers and hat.

While Hernandez's family is blaming Toro for reacting too quickly, other officers seem to think that Toro did the best he could under the circumstances. The NYPD is conducting an investigation.

I've never seen cops turn or blame their own so quick before. I mean almost everyone is blaming Hernadez without the benefit of the doubt.
Especially with this blood alcohol leak. Did Hernadez consented to the blood test? Even a DWI suspect get's to refuse the test.
Something stinks in the state of Denmark.
When was the last time you heard the term "grave" when refering to a patients medical condition????
To paraphrase a few good men, Is there any other kind of danger?

Gotta agree with the previous comment. It's probably messed up for me but it's hard for me to feel sorry for a drunk cop who seems to have a problem with just walking away and avoiding confrontation with a group of punks.

Oh come on. White castle is best when you're drunk! I stumble in there all the time when I get a craving.

Am I the only one seeing some stomping action in the video? You try hearing orders when your ear is swollen like a cauliflower and you head is used as a kick ball.
Drinking is part of the culture, you don't drink after work, you don't get the primo assignments or OT.
You do know most cops drive to work right and don't live in the confines of the 5 boroughs.

This White Castle has a zillion cameras pointing at you in every direction and you order through bulletproof glass an inch thick. Last time I was there a crackhead and his cracklady asked for some change and said he just got out of prison, that he was celebrating.

The guy is beaten and shot and the NY Times is wringing their hands about whether he violated the PD rulebook by having an alcoholic beverage. Blame lies squarely with the guys that beat him up.

mr. hernandez is fighting for his life-respect that- was he driving? was he so drunk that he was not able to pay for his food? what is the leagal limit for walking drunk? or public intoxication? did anyone leak a report of the interview with the cashier as to his condition? or other people that may have come in contact with him prior to the shooting but again we believe the first reports as always, we believe the police oficers version of "stop, drop your weapon!" please wait , a rush to judgment is not wise lets hear the account from the non police officers at the seen. wait for all the facts.............and ask questions

I would like to add a comment. I have know eric for years and as much as the public is blaming him...hes fighting for his life. The media is making out that he was sooooooooo drunk but for those of you who have had a few drinks, he got a .16 thats like 4 beers and he was out all night and he was able to walk into a place buy food, etc. Yeah, he didnt drop his gun off which probably wasnt the smart thing but if it wasnt for those thugs and them bashing his head and beating him off noooo reason he would not be in the situation he is in. I also think cop toro was alittle excessive in his shooting, eric went down after the first shot.... you really think two more were needed? now eric has had to have his leg amputed, his colon, intestine taking out, and ontop of many other things.... such a sweet guy and football star..and now his whole life has changed thanks to 5 thugs trying to start trouble. Nice job!

I think its very sad that society as a whole never get the facts first. If some of the people that have such negative things to say were to know the facts they would feel sick for being so cruel. I just wanted to make light here that Eric is FIGHTING FOR HIS LIFE! It's the comments like what I have read above that make you have to remember the country that we live in. It also makes you see why we are hated by so many other countries! I dont think it is fair for the haters to know his condition at this point so lets not broadcast Erics condition next time but I know where you are coming from...

police are on duty 24/7 so it's not a big deal for a guy just off his shift to have a few beers while still with his "off duty" weapon, it happens. If he thwarted a robbery in progess inside the White Castle he'd be a hero for having his gun... The guilt of this whole thing is with the losers who are only brave enough to fight a guy with the help of 5-others. I've seen punks like group all too much, real tough when they've got back up but alone anyone one of these guy's would have prob. cried if Officer Hernandez kick the deserving "ghetto ignorance" out of them. Rest in peace Bro. EC
