In the court hearing of Bernard Derr, the man who nearly disemboweled a baby sitting in her stroller in Washington Heights, Derr's police statements after the incident were released, revealing that he had to stab the baby because roommates at his group home were bothering him. In one statement, Derr said his roommates' requests for him to clean up made him angry ("Those two fellas made me angry. I was going to stab them and then decided to stab a baby. I knew it was wrong to stab the baby, but I had to feel better.") while in another statement, he said, "They were just hounding the s--- out of me and trying to 'f--- me' because [they are] homosexual. I said, 'F--- it. I had to kill something,' so I grabbed my knife that I bought ... and went outside and stabbed the baby in the stroller because I had to kill something." And then after the stabbing, he went back to the group home, waiting for the police.
Derr pleaded not guilty, so the judge ordered a psychiatric evaluation; Derr's lawyer also said she "had trouble communicating with him." Given that he was living in a group home for the mentally ill, Derr may not be found fit enough to stand trial. The baby, Isabelle Avins, is out of the hospital and doing better, considering.

this guy is clearly a menace to society. why waste money on psychiatric evaluations and a trial? he needs to be killed. end of story. i would gladly pull the trigger on this scumbag myself.
absurd revenge fantasy or not, is she actually wrong?
Yeah. She is wrong.
I'm with Stephanie. It's obvious that this monster is a homicidal psychopath with no chance of ever being cured. What do the squishy no capital punishment types propose to do with him?
i agree with stephanie. we should absolutely kill every crazy, psychotic person in new york. the fact that they are completely whacked out of their minds, don't know the difference between right and wrong, and won't understand why they're being killed shouldn't be a deterrent.
besides, what do these fancy psychiatrists with all their book-learnin' and degrees and junk know about schizophrenia anyway???
stephanie is an idiot.
why is it so "obvious" that this guy has no chance of being cured? you haven't ever heard of anti-psychotic drugs?
Not all life is precious, kill him
thanks – when i'm looking for moral guidance, i'll be sure to call on a guy named "boner".
he admits he knew the difference between right and wrong...
"I knew it was wrong to stab the baby, but I had to feel better."
to all you that defend this guy, would you want to live next to him - even if he were to be medicated and 'cured'?
"I knew it was wrong to stab the baby, but I had to feel better."
this to you sounds like the statement of a sane person??? forget living next to him, i would be afraid to live next to you!
and, just so you know, justice isn't dispensed based on who would make a nice neighbor.
stephanie berger is a menace to intelligent life. she needs to be killed, end of story
If somebody had killed the guy while he was trying to stab the baby, I'd be perfectly OK with that. Happy ending. Now however, as human beings, we must respect this psychopath's right to live. We can medicate him and let him out on the street again so he can fall inbetween the cracks, go off his meds and stab another baby, or push somebody in front of a subway. We live in a humane society in which we highly respect the rights of insane baby stabbers and murderous thugs while lampooning innocent people like Nicole Dufresne, whose horrible crime was to have a few too many drinks and mouth off to someone who deserved to be beaten to within an inch of his life for sticking a gun in another human being's face.
"I knew it was wrong to stab the baby, but I had to feel better."
that sort of kicks some of the "unaware of consequences of actions" thing out the window, don't it?
for all you who defend this deadbeat so blatantly, i can only say this - too bad that wasn't your baby this monster tried to kill; too bad that wasn't you he tried to kill.
i don't advocate killing every psychotic, crazy fucker out there. but i highly advocate killing this guy. fuck, hang him off a lamppost on his own block. let his neighbors experience the pleasure of seeing this monster suffer and die in pain.
stephanie, will you marry me?
xoxoxo
Joe,
Not that I'm defending anyone here, but what is your hope for Mr. Derr? Do you hope he goes on antipsychotic drugs and is eventually released? Or, like me, do you hope that his "society membership card" (i.e., freedom) is permanently revoked for his remaining days on the planet earth?
asdf,
yes, that's exactly my hope.
unfortunately nothing can undo his actions. but don't you want to live in a world where it's at least *possible* that something good could come from a horrible situation? and that maybe this guy might someday give something back to society to try to at least partially right his wrong?
or do we just say "f*** it, i know nothing about this guy but i'm sure he's hopeless and can never do anything good. let's feed him to the lions"? might satisfy a little blood lust but, in 2005, shouldn't we be above that?
Joe - Locking up a deranged, attempted baby-killer for life in an environment where he gets three hots and a cot, meds and counseling, in my opinion, is not akin to feeding him to the lions. I place too much value on the lives of law-abiding people who are not crazy and dangerous to believe people like this are worth taking any risk on whatsoever.
There are already enough loonies and thugs out there who haven't killed or violently assaulted anyone yet that I have to worry about. I shouldn't have to also equally worry about all the ones who have *already* proven themselves unworthy of occupying the same space as innocent babies and my friends and loved ones.
I think we as a society place too little value on human life by insisting on freeing violent felons and violent crazy people.
I just wonder if it really did make him feel better.
cant he be harvested somehow? Labor is one thing, but how about harvesting blood and organs from him? That way, he would be giving back to society, and some good could come from a horrible situation.
Have fun being a rape-doll, dude. I love the fact that he'll be raped by guys then stabbed with a shiv. Sometimes the system works, it turns out.
That must have been some apartment mess to clean up, I'd imagine. I get pissed just at the thought of cleaning the bathtub ring.
There's nothing I'd like better than to see this guy killed, but at the end of the day, I'm with Joe. There's a lot of people I'd like to see dead, but that doesn't make it right to kill them (unless it was self defense like some other poster mentioned.)
And for those who call anti-death penalty folks "squishy" or "defending criminals," you need to check yourselves. We're just being honest. Sure it's easy to sit in a comfortable chair at a computer and determine whether someone else lives or dies. (BTW, it wasn't your baby either, so who the hell are you to claim the moral high ground?) If you feel that strongly that he should die, why don't you do the job yourself, instead of paying someone else to do it.
