A 28 year-old actress-playwright, Nicole duFresne, died from gunshot wounds during a robbery on Clinton Street near Delancey early Thursday morning. The Brooklyn resident had left Max Fish with her fiance, Jeffrey Sparks, and two friends at 3:15AM when they were approached by two teenagers, demanding their money. Sparks pushed past one of them, who hit him in the face with a gun. Then, according to the police, it seems that the would-be robbers demanded duFresne's purse, and duFresne protested. Sparks says he heard her say, "What are you going to do, shoot us?" One teen did shoot duFresne, who was still breathing and "died in [Sparks's] arms." Sparks added, "It looked like it's probably the first robbery he'd ever done. He wasn't good at it." duFresne had just finished her first night tending bar at Rockwood on Allen Street, and had been working on a pilot for The Food Network with Sparks. She also had a play performed in the Fringe Festival in 2003. The police are looking for the gunman, who is described as being black, slim, about 5-feet-8, wearing a parka and a scarf; tips can be called into (800) 577-TIPS (577-8477).
The NY Times noted the similarity between this incident and Burke O'Brien's death on Orchard Street two years ago. The O'Brien murder also occured in the early morning, around 4AM. This makes Gothamist think that even though the Lower East Side is hopping with bars and activity, like any part of the city, it's vulnerable at night.
Update: Dewey DuFresne, father of Wylie Dufresne (wd-50) and not related to the victim, tells Newsday, "I'm concerned for my wife and her friends, people who live and work in the neighborhood and others who get out late of the restaurant. It's the kind of thing that used to happen here a lot, 10 or 12 years ago, when I first came here." The Newsday article also talks about the L.E.S. "being on the upswing."

Some people choose their money over life. Hard lessons learned, you get mugged in the Lower East Side at 3 in the morning, hand it over, they don't care about your life. She'd be alive today and he probably wouldn't have had a new lifetime of misery ahead of him.
that sucks, i feel like there have been a lot more muggings in general lately. i have heard that in a mugging situation, the worst thing you can do is to say something like "what are you gonna do, shoot us?" as this often does lead to getting shot.

Sounds like because these robbers were so small and lame that they thought they could get by them. But there's nothing more dangerous than someone small and lame with a gun.
We were in the 2003 Fringe... it's sad, you meet like 1,000 people when you do a Fringe Festival, they all slide by, and then they become vaguely familiar. Then something like this happens and that's all you have to remember them by is that.

That area is still very much the border zone. Clinton while now a restaurant row, is not too far from Pitt and the housing projects. Last year it wasn't uncommon to find people still looking for a coke fix and having knives pulled on them, ala LES in the mid 90s. There was even a stabbing on Orchard, the gentrification nexus. But I have to say that the police presence has tripled in the past few years, even to the point of undercover cops.
Jimmy Legs wasn't "blaming the victim," he was pointing out that what she said was a profoundly STUPID thing to do. Should we all agree that it OK for her to have said "What are you going to do, shoot us?" or "I bet you don't have bullets in that thing, you dumbass!" because gosh, if we say that was a STUPID thing to do, and that people shouldn't taunt their muggers on the LES at 3 in the morning then gee, we would be blaming the victim!

the times is often wrong. but according to the times the boyfriend pushed the would-be muggers aside, and then someone taunted them with "what are you gonna do know, shoot us?"

Maybe I'm just hopelessly stuck in the '70s, but I wouldn't consider any part of NYC safe in the middle of the night. I haven't lived as long as I have without a little paranoia and suspicion.
I'm saddened to read about what happened. No one should ever get robbed or shot for resisting. However, the cold reality is this is New York City.
When you're out in the streets at 3am, possibly abit inebriated, and in a high crime area, you are just looking for trouble. We all have a right to come and go in the city, but everyone needs to understand that just can't walk around the city, especially late at night or early in the morning, without knowing that there are predators out there looking for victims.
Even though the area has been gentrified, it's still a dangerous neighborhood. It's sad to say, but as long as there are projects or low income housing, there will be a higher crime rate in the surrounding area.
Basic rule of survival, if confronted in a robbery attempt, don't resist and give them your money/valuables. You're less likely going to get hurt.

Many immigrants come into this country with just the clothing on their back and yet many of them don't turn to crime, they work long hours for little pay, sometimes 2 - 3 jobs, live in tiny apartments, raise a family, put their children through school & college, open businesses, and purchase homes.
You hear stories all the time about gypsy cab drivers, chinese delivery men being robbed and killed all the time. They scrounge and try to earn a living, even if it's below minimum wage. They don't ask for handouts like welfare because for them, it's a matter of pride and upbringing.
There would have to be both a lot of "drunken" and "bravado" in "drunken bravado" to taunt a man with a gun after your fiance gets pistol-whipped with said gun in front of you.
Interestingly enough (if all facts reported are correct), if it all was in question, certainly modern day chivalry has to be considered dead when a man walks a block away from his fiancee and female friend and leaves them alone in the company of armed thugs who just pistol-whipped you.

I've lived on the LES for a number of years now, and yes, crime is going back up. Just within the past two years I've personally had about six crimes happen within one degree of separation, within a five-block radius from the above mentioned murder. Robberies, muggings by knife, stolen mail (credit card), being jumped. There's also more homeless and things are getting dirtier around here.
Outside of the LES friends of mine have been mugged at gunpoint, chased, and slashed from mouth-to-ear.
Regarding the slain actress-slash-model: What I don't understand is, the victims were from Brooklyn, and they left Max Fish (on Ludlow) but were mugged on Clinton, which is the opposite direction of anything happening at 3am. It's also the opposite direction of any train. There's not many nightspots where they were headed.
The only place I know of near Clinton and Delancey is "The Delancey," but I think they were probably lost and wandering around, not paying attention to their surroundings. (A lot of people assume that if you're walking as a couple that you're safer, which is incorrect). The muggers most likely also knew that nobody would be walking there so late unless they lived there, or were lost (=easy prey).
They were heading back to someone's house. I guess they thought they knew the turf.
Friends, anyone who walked the streets in the 80's or early 90's knows to keep a lookout, especially at 3 in the morning and especially in a marginal block. Things are certainly much better but they are not always great. I, too, was a little baffled by their conduct upon encountering two guys with a gun, but let's face it, you're on auto-pilot when that happens.
Depsite the continuing plunge in crime statistics, which can be easily manipulated (my old man was a cop), things are dirtier and there are more people on the streets. If something good can come of this, it may be that incidents like lois aida's may now come to people's attention (like the police and the community) and stop living in this "safest big city in America" self-delusion.

People please. This is a tragedy. The guy who murdered this woman should be caught and brought on trial. But it really takes two to tango. If someone wants money, give them the money. They want your iPod, give them your iPod. Fight back only if you know you have a fair chance of escape and if the other person has a gun, don't think you can dodge a bullet. This kind of shit is what really pisses me off about new residents in NYC. They think it's all a joke. It's not. Get a clue and live. And may this poor woman's family and friends find some solace in this time of tragedy. And may we all learn a lesson about life from this. Your property and money mean nothing if you're dead.
One interesting thing mentioned on the news was the fact that the other assailant (not the shooter) apologized to the couple after the violence went down...it sounded, at least from the article that i read, that this was a quick scare mugging gone horribly wrong....i agree that its not smart to get aggressive in this type of situation, but it also sounds like pretty much no matter what she or the boyfriend would have said or done, if someone is ready to snap....
This whole tragic and awful thing has some oddnesses about it. The boyfriend who got pistol-whipped then continued to walk down the street without apparent regard for his girlfriend a block behind; his comments that seem remarkably glib for someone whose finace was just murdered; his next-morning appearance on "Good Morning America." It's hard to add all this up. Meanwhile, a young woman's dead, her family devastated, a young man's headed for a life with no future. Awful all the way around. The only lesson I can draw: New York at 3AM's not some game, whatever the Compstat crime numbers say. Condolences to the family, a prayer for the perpetrator, and a raised eyebrow to the "gen-whatevers" who survived the ordeal.

I think paying them by the hour would be best as then we could pay them time and a half to not rob us during midnight and 6am and pay them double time to not kill us during holidays!

While I am way on the other side of the nation, I am horrified at this story. If the young women had just finished bar-tending, she most assuredly was not drunk or tipsy. Why should any citizen have to live in constant fear for their life? Notice: white victims, black assailant. Yes, if roles were reversed, the ethnicities might be different! As a protecting of my wife male, I let you know that I would not have left my partner alone there.
